Terms for Electronic Transactions and Records
Please read this carefully and retain a copy for your reference.
1. Definitions.
“We,” “us,” and “our” means Shogun Enterprise Inc, doing business as Hearth or Hearth Brokerage (“Hearth”), its successors, and assigns.
“You” and “your” means the person giving this consent.
“Records” mean all documents and information related to your use of our personal loan request tools, financing request tools, payment or contractor services, or other products and services offered on our websites or via our automated tools. “Records” include, without limitation:
- applications or requests you submit;
- disclosures and legally required notices;
- information about actions taken on your requests;
- privacy policies and agreements;
- communications between you and us or between you and any lender, provider, or contractor;
- any call recordings, transcriptions, summaries, or automated analyses produced by our systems; and
- any other information or communications relating to products or services you obtain through us.
2. Scope of Consent.
By accepting these Terms for Electronic Transactions and Records, you consent to conduct transactions with us and Hearth’s lending partners electronically, use electronic signatures and Records, and receive electronic mail (email) and electronic communication with respect to any and all transactions and Records regarding your account, instead of receiving them in paper or by regular mail. Your consent will be effective unless you withdraw it in the manner provided below.
We may provide Records to you electronically by email (including attachments and embedded links); by posting them to our websites, contractor portals, widgets, or applications; or through automated or AI-powered communication systems.
Your consent remains effective until withdrawn as provided below.
3. Consent to Automated Systems, AI Processing, and Call Recording.
By providing your phone number, email address, or interacting with our tools, you expressly consent and agree that:
- You may interact with automated systems, including artificial intelligence (“AI”) tools, automated voice assistants, messaging assistants, or other non-human technologies.
- Your calls, voicemails, messages, and other communications may be recorded, transcribed, analyzed, or otherwise processed by automated or AI-based technologies.
- You consent to the use of automated dialing systems, prerecorded/artificial voice calls, automated text messaging, and AI-generated or automated messages for communications related to your requests, your account, or products and services offered through Hearth.
- AI-generated responses may be inaccurate or incomplete, and you agree not to rely on such responses as legal, financial, or professional advice.
- Any financing information provided by Hearth or through automated systems is illustrative only, not a loan offer, and may not reflect actual approval terms.
- Your interactions may be used to operate, maintain, and improve our systems, including improving automated tools and AI models, consistent with our Privacy Policy.
- Hearth’s automated or AI systems do not monitor for emergencies and should not be used to report urgent or time-sensitive issues.
If you do not consent to automated or AI processing, you may not be able to use certain features or complete certain transactions.
4. How to Update Your Contact Information.
You agree to provide us with your accurate email address and personal contact information and to promptly notify us of any changes. You can update your information (including your email address) by contacting Hearth Customer Service at 855-997-7550 or by emailing [email protected]. If email is undeliverable to your email address for three consecutive months, your consent will be considered withdrawn and we will send you future Records in writing.
5. Obtaining Paper Copies.
You may obtain a paper copy of a Record by printing it from your computer or contacting Hearth Customer Service at 855-997-7550 or by emailing [email protected]. We may charge you a reasonable service charge for providing you with a paper copy of any Record if permitted by state law. The request for a paper copy of a Record will not by itself constitute a withdrawal of your consent to receive Records electronically. We reserve the right, but are not required, to send a paper copy of any Record you authorize us to provide electronically.
6. Failing to Provide Consent and Withdrawing Consent.
If you do not consent to the use of electronic signatures, Records, and automated communication terms, you will not be able to complete the transactions involving loan requests, financing inquiries, payment services, or other products that require electronic disclosures.
You may at any time withdraw your consent at any time to receive Records electronically, and instead elect at any time to use the U.S. Postal Service to obtain Records, by contacting Hearth Customer Service at 1-800-555-8733 or by emailing [email protected].
We will not impose any fee if you withdraw your consent to receive Records electronically, but communications between you and us will be slower. If you withdraw your consent to receive Records electronically, such withdrawal will not apply to Records that were furnished by us to you electronically before the date on which the withdrawal of your consent takes effect.
7. Hardware and Software Requirements.
In order to use Electronic Transactions and Records you need to have an electronic device that satisfies the following:
- Active email account
- Internet access with 128-bit encryption
- a device capable of receiving and viewing emails and web content
- Adobe Acrobat Reader 6 or higher
- Ability to Print Internet Explorer 6 or higher
- Netscape 8.04 and above (Use in IE mode)
- Email Access or Firefox version 1.5
- the ability to download, save, or print documents.
Save and print a copy of this document to make sure that you have the necessary hardware and software. If we ever change the hardware or software requirements in a way that creates a material risk that you will not be able to access or retain a Record that we previously sent you, we will send you notice of the revised requirements. Please save and print a copy of these Terms for Electronic Transactions and Records to confirm that you have the required hardware and software to conduct electronic transactions with us.
8. Agreement and Affirmative Consent.
By clicking on any button indicating an acceptance or agreement to terms, a continuance of processing or submission (“next”) you agree that:
- You have read this consent
- You have read and agree to these Terms for Electronic Transactions and Records.
- You consent to use electronic signatures and Records
- You consent to automated communications, call recording, transcription, and AI-based processing as described above.
- You confirm that have the necessary hardware and software needed to access, retain and review Records, and
- Your consent applies to every Record and communications provided electronically during your relationship with Hearth, unless and until you revoke your consent.
